Hello, everyone. I wanted to make this video today. We’re getting a lot of questions regarding the probate process. What happens when you inherit a home through probate? How do I sell a house fast in probate in Omaha or Council Bluffs? What do I have to do or not do when I have a house in probate? So what I thought I’d do is explain the probate process and let you know what we do if there’s a house involved in probate and how we may or may not be able to work together. The probate process can be very, very confusing, very stressful, and overwhelming. It’s something that we don’t deal with on a daily basis nor do we want to deal with it on a daily basis. But at times, we just have to.

Many people don’t know what to expect or how a house in probate is going to be handled. The process does vary from state to state, but there are a few basic things that you can count on. The best situation that could be is if there is an executor for the will and it’s all spelled out clearly from the deceased. If there’s no will, it’s called in testate. What that means is that the courts are going to go through and appointing an executor to the will. Creditors will be notified. Estates can be tied up for months in courts, just sorting out all the bills, sorting out the heirs or the beneficiaries to the deceased. So there’s a lot of things that need to be decided there. The court will handle all the claims against the estate. They’re going to deem whether the claim is valid or not valid. Once the claims are all cleared up and deemed valid by the court, the court will then distribute the leftover portion of the estate to the heirs.

In the meantime though, the executor is going to have to identify all the living heirs to the deceased and then the court will decide who if any one of the living heirs and what they have entitled to them from the deceased. The executor will also be responsible for accounting for all of the assets of the deceased from bank accounts, investment accounts, personal property, vehicles, houses, any type of asset that the deceased has to be accounted for.
